An illegal immigrant from Mexico that has been charged with murder and first-degree arson could be released back onto the streets of New York after Department of Homeland Security officials have said that city officials are refusing to turn him in to ICE.

Roman Amatitla, 38, allegedly set fire to a three-story New York City apartment building on March 16, killing four people and injuring seven others.

“This monster set fire to a building and watched as innocent people, including a three-year-old, burned to death. New York City sanctuary politicians REFUSE to cooperate with ICE and are committing to RELEASING this MURDERER onto New York streets. New York’s sanctuary politicians must stop putting politics above public safety. We are calling on @GovKathyHochul and @NYCMayor to commit to honoring this detainer and turning him over,” DHS said in a statement.

Authorities have said that Amatitla entered and exited the building multiple times, urinated on the front apartments, went to a nearby gas station where he bought a bear and took a pack of matches after declining to purchase a lighter.

Police said that after he entered the building for the fourth time, he lit a piece of paper on fire and then tossed it into trash by the stairwell. Queens District Attorney Melinda Katz said of the incident, “This was an act of mass murder. As alleged, Roman Amatitla deliberately set a fire in an occupied building and killed four people, including a 3-year-old girl. Shockingly, the defendant had no known connection to the building or any of its occupants and selected the building at random.”

After lighting the fire, authorities said he stayed in the immediate area to watch people burn in the building and jump from the windows of the apartment complex.

According to the New York Post, because of New York’s failures to honor ICE detainers when illegal alien criminals are detained, it has resulted in the release of 6,947 illegal immigrants from Jan. 20 to Dec. 1 who have been accused of crimes.
