Woman Faces Manslaughter Charges After Toddler With Down Syndrome Drowns in Bathtub
A 25-year-old Seattle mother faces first-degree manslaughter charges after her 2-year-old son with Down syndrome drowned in a bathtub, an incident that is a tragic illustration of how vulnerable children with disabilities can be left unprotected in a culture that too often devalues their lives.
Nakeeya L. Arbogast was charged Monday by the King County Prosecuting Attorney’s Office in connection with the July 11 death of her son. Prosecutors allege she placed the toddler face down in the bathtub, turned on the water and left him unattended while she tended to her two other young children and spoke by phone with the children’s father — despite a domestic violence no-contact order.
The child, who had Down syndrome and significant physical and developmental delays that left him unable to crawl, walk or sit independently without support, was found unconscious on July 9 in the family’s Northgate apartment. Arbogast called 911 and performed chest compressions as directed by the dispatcher. The boy was transported to Seattle Children’s Hospital, where he died two days later from hypoxic brain injury caused by prolonged lack of oxygen.

Court documents state Arbogast initially estimated she had been away from the bathroom for only a few minutes. Investigators determined it took more than 14 minutes for the bathtub to fill to the level at which the child was later found, indicating he had been left alone longer than she claimed. She acknowledged knowing it was unsafe to leave her son unattended in the tub and said she had previously used a special bathing chair but had left it behind at a former residence because it became moldy and uncomfortable for him.
Prosecutors note the child was particularly vulnerable because of his disabilities and that the offense occurred within sight or sound of another minor child — factors that could serve as aggravating circumstances. Family members had previously heard Arbogast threaten to kill her children, according to charging papers, though she denied any intent to harm her son or ever making such threats.
Arbogast has no prior criminal history in King County. Prosecutors are seeking to maintain her $1 million bail and requesting electronic monitoring, no contact with minors, and other restrictions.
The death of this little boy underscores the profound moral duty to protect the most vulnerable among us. Children with Down syndrome are fully human persons endowed with inherent dignity, yet they face disproportionate risks of devaluation — both in the womb, where the vast majority of prenatally diagnosed cases end in abortion, and after birth, when neglect or indifference can prove fatal. This case is a heartbreaking reminder that every child, regardless of ability, deserves vigilant care and the full protection of society.
