Texas Secures Major Immigration Win, Halts Biden’s Dismantling Of Border Wall
The Biden Administration announced Friday that it will stop selling off materials slated to be used for building a border wall along the U.S. border with Mexico. Friday’s capitulation comes just weeks ahead of President-elect Donald Trump’s inauguration, who has vowed to make border wall construction a top priority after the project was stonewalled by Democrats and establishment Republicans during his first time.
The ruling came after Texas Attorney General Ken Paxton sought to stop the lame duck administration’s attempts to complicate border wall construction during President Biden’s final weeks in office. The hearing was called upon Paxton’s request to uncover potential legal violations committed by the Biden Administration after recent reports that segments of the border wall were auctioned off for “pennies on the dollar,” Paxton’s office announced in a press release.

“The Biden Administration confirmed to the court today that it will agree to an order preventing the outgoing administration from disposing of any further border wall materials over the next 30 days—allowing President Trump to use those materials as he sees fit. This will be adopted as an order of the court, making it enforceable if any violations occur,” the release continued.
In addition, the court ruled that Texas is entitled to documentation proving that the Biden Administration has not violated an injunction secured by Attorney General Paxton in May of 2024, which required the Biden Administration to spend statutorily obligated funds on border wall construction after the federal government attempted to illegally redirect the money. If it is found that the Biden Administration sold off border wall materials purchased with funds subject to the injunction, or if the Department of Justice failed to accurately report on border materials that have already been auctioned off, the responsible parties could be held in contempt of court.
“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” Paxton said in a statement Friday. “This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda.”
In January 2021, the Biden Administration abruptly ended border wall construction after 450 miles had been constructed during Trump’s first term. Border wall materials were later auctioned off starting in 2023, as parts were listed for sale on GovPlanet.com, an online auction marketplace. The Department of Defense confirmed that materials had been turned over to the Army Corps of Engineers and were now for sale.
Auctions have continued well past Trump’s re-election. According to a recent report from the Daily Wire, officials in Arizona have continued to dispose of materials that could be used for new construction when Trump takes office next month.
