Senate Majority Leader Chuck Schumer (D-NY) faced a stinging defeat following the 2024 election as Republicans solidified their hold on Congress and President Trump reclaimed the White House. This latest blow came when Schumer’s effort to secure a Democratic majority on the National Labor Relations Board (NLRB) failed, marking a dramatic shift in the political landscape.
Schumer had hoped to confirm Lauren McFerran, the current NLRB chair, for another five-year term. With her reappointment, Democrats would have maintained a 3-2 majority on the board, which influences labor disputes and policies affecting companies nationwide, including major players like Amazon and Starbucks. However, Senators Kyrsten Sinema (I-AZ) and Joe Manchin (I-WV) broke ranks, voting ‘no’ on a crucial procedural motion that blocked McFerran’s confirmation.
The failed nomination means President Trump will have the opportunity to appoint McFerran’s replacement, ensuring the NLRB reflects a more conservative, pro-business stance. Axios described the outcome as a “dramatic and consequential defeat for Schumer and the labor movement.”
Schumer voiced his frustration, stating, “It is deeply disappointing, a direct attack on working people, and incredibly troubling that this highly qualified nominee — with a proven track record of protecting worker rights — did not have the votes.”
Conversely, industry leaders welcomed the decision. Tim Wagner, President and CEO of the Power & Communication Contractors Association, expressed relief, saying, “After years of being burdened with her impractical and unconstitutional policies, it’s time for a fresh approach to labor policy. The Senate’s decision to reject McFerran is a significant step in that direction.”
