‘Painfully obvious you made a mistake’: Fired professor blasts ‘woke’ school board after Judge’s ruling
A professor allegedly dismissed for his political beliefs slammed the board behind the DEI-linked termination with a stark, post-injunction reality check.
“By now it is painfully obvious that you made a mistake.”
In April, Matthew Garrett, a tenured history professor at Bakersfield College in California, was let go in what many considered to be a violation of his constitutional rights. While the Kern Community College District cited “unsatisfactory performance” and “unprofessional” conduct, a judge’s ruling in a related lawsuit had the professor demanding his job back.
Speaking at the Dec. 12 KCCD Board of Trustees meeting, Garrett referenced “Antigone” when he informed members unequivocally, “In the end, you will lose.”
“By now it is painfully obvious that you made a mistake. You cannot hope to prevail in court. There is no value in dragging this out,” he expressed as he laid out reported facts, including the ruling from U.S. Magistrate Judge Christopher Baker that argued the professor’s First and Fourteenth Amendment rights had been compromised, as well as whistleblower rights.
“I can’t stop you from making this process painful for me and my family. You have driven me onto welfare. You have robbed my children of Christmas. You’ve taken food out of their mouths, and it’s true that you can make me suffer more. But I am unbreakable,” Garrett declared. “In the end, you will lose.”
“The longer this drags out, the greater the cost to the taxpayers. At this point, you are on the hook for at least a few million dollars for retaliation, defamation and legal fees,” he asserted. “That is unavoidable now. But if you continue on this path, you could very easily double or triple that expense.”
Responding to a June lawsuit filed by Garrett’s peer, Professor Daymon Johnson, who sought to stop the college from retaliating against those with differing political views, Baker’s November injunction suspended the state’s Diversity, Equity, Inclusion and Accessibility regulations and wrote, “Although Defendants’ aim of promoting diversity, equity, inclusion and accessibility in California’s system of community colleges undoubtedly is important and Defendants are entitled to encourage their employees to embrace these tenets, Plaintiff has shown a likelihood of success on the merits that the regulatory scheme Defendants have put in place to advance these interests is contrary to the First Amendment’s guarantee of freedom of speech in the academic arena.”
The suit had alleged that Bakersfield College had become aware of op-eds composed by Garrett and radio show appearances he had done after he had spoken out against prevalent “cultural Marxism.”
Though the fired professor called for the board to let go of their pride and do the right thing to put the termination in the past, a statement from a KCCD spokesperson to Fox News held firm in support of the DEIA policies of California.
“Regarding the litigation concerning the State Diversity, Equity, Inclusiveness and Accessibility regulations, KCCD has filed objections to the Magistrate Judge’s recommendations, as has the State Chancellor’s office. The State-mandated DEIA regulations do not force faculty to adopt ideological concepts, and KCCD has not and will not enforce the regulations in that manner,” the spokesman said.
“KCCd asks faculty to promote and encourage an inclusive environment in their classrooms and committees and will continue to do so,” the statement went on. “Our commitment to our students and community leads our goals, and we believe this lawsuit is without merit. As such, KCCD will continue to vigorously defend itself.”
Before concluding his remarks, Garrett asserted, “You’ve become the Grinch who stole Christmas for my children. But in the end it is the Kern County taxpayers who will be robbed. Is that really what you want to do?”
