NEW: RNC Hits Blue State With Sweeping Election Integrity Lawsuit

The Republican National Committee (RNC) has filed a lawsuit against the state of Maryland on Friday over their alleged failure to properly maintain state voter rolls.

The RNC alleges in the lawsuit that voter registration percentages in multiple Maryland counties is “impossible high,” with two of the state’s largest counties reporting more registered voters than eligible adult citizens. Ten additional counties have registration rates that exceed 95 percent, the RNC further alleges, according to a report from the Daily Caller.

Plaintiffs include the RNC, the Maryland Republican Party, and named individuals such as Kathleen S. Toothman, a registered voter and MDGOP member. The defendants are the four members of the Maryland State Board of Elections, State Administrator of Elections Jared DeMarinis, and the members of the Howard County and Montgomery County Board of Elections.

These entities are accused of failing to conduct reasonable efforts to remove ineligible voters from the rolls.

The complaint claims that Maryland has not adequately updated its voter rolls by removing registrations of deceased individuals, those who have moved out of state, or duplicates. It cites a 2023 audit by the Office of Legislative Audits of the Maryland General Assembly, which identified 2,426 potentially deceased individuals with active registrations and 327 potential duplicates.

The suit further alleges that voter registration rates in several counties are implausibly high, with two populous counties reporting more registered voters than adult citizens aged 18 and over, and ten other counties exceeding 95 percent registration rates, compared to the state’s overall rate of approximately 75.6 percent according to 2022 U.S. Census Bureau data.

This purported failure is said to undermine voter confidence and burden the rights of eligible voters by potentially diluting legitimate votes.

The plaintiffs seek a court declaration that Maryland’s practices violate federal law, an injunction requiring the state to conduct a comprehensive audit and removal of ineligible registrations within specified timelines, public disclosure of voter list maintenance data, and attorney’s fees.

“Marylanders deserve to have confidence in their elections and to know that their state is properly maintaining its voter rolls. The State Board of Elections has failed to do its job and remove ineligible or deceased voters from its rolls,” said RNC Chairman Joe Gruters. “Marylanders have a right to accurate voter rolls, which is why the RNC is suing today.”

The lawsuit follows two prior federal court actions against Maryland in the last six years for similar NVRA compliance issues, as well as a July 2025 notice of intent to sue from the RNC. It occurs amid broader national scrutiny of voter roll maintenance, including a separate December 2025 U.S. Department of Justice lawsuit against Maryland and five other states for failing to provide voter registration lists upon request.
