DEVELOPING: Here We Go Again: Another ICE-Involved Shooting, This Time in Austin (VIDEO)

This is a breaking story, so the 24-hour rule applies; All reports within the first 24 hours are suspect. But we will strive to give you the most accurate information.

As you know, any time any ICE Agent shoots any human being in America, this is suddenly breaking, national, super-important news, and the left will assume that this was wrong and unjustified. And the sane people like us will actually wait for the facts. Crazy idea, we know, but let’s go with it.

The bottom line is this is what we know for sure as of this writing: A man was shot by an ICE Agent. He appears to be, as of this writing, alive. That’s it. 

We also have a high degree of certainty that his name is ‘Wilber Rafael Garces Perez, a 28-year-old Venezuelan national’ (from a CBS article we shall share shortly).

We have differing claims about the circumstances that led to the shooting or even what ICE was up to. We are not in the ACAB or ACAA camp. (ACAB stands for All Cops Are B******s while ACAA is an acronym we just made up that stands for All Cops Are Angels). That is, just because this is a shooting by a law enforcement officer, this author will do no more than extend to the law enforcement officer the usual presumption of innocence we give to all people suspected or accused of wrongdoing. But that is just a starting assumption that can be overcome.

A federal immigration agent shot and wounded a man on Sunday in Austin, Texas, authorities said.

The shooting occurred shortly before 1 p.m. local time on the city’s north side. Chief of Austin-Travis County EMS Robert Luckritz said at a Sunday news conference he believes the man was shot once in the torso and that he was still in serious condition.

Austin Mayor Kirk Watson said that, while the man’s condition was serious, he was stable.

A lawyer for the man who was shot identified him as Wilber Rafael Garces Perez, a 28-year-old Venezuelan national. Attorney Kate Lincoln-Goldfinch told CBS News that Garces Perez called his wife while ‘yelling in pain’ at Dell Seton Medical Center at the University of Texas.

Lincoln-Goldfinch said she has had no updates on Garces Perez’s condition or whereabouts for at least six hours and could not confirm his legal status as of Sunday evening.

‘The focus right now is trying to find him and ascertain his medical status,’ she said.

She also claimed to have been kept away from the hospital by law enforcement. While naturally a person has a right to have counsel present while they are being interrogated, that right does not attach if he is merely in custody without being interrogated.

As for his identity, while Ms. Lincoln-Goldfinch identifies Mr. Garces Perez as the man who was shot, ICE is being more cagey, refusing to verify her claims. But naturally, it seems to be unlikely that she is wrong on this point.

And, of course, if he called is wife, it gives you some insight into his medical condition — i.e. he was well enough to talk.

So how did this actually happen? Well, of course, not knowing the facts didn’t slow people down:

Over and over, ICE has shot people and then lied about what happened. We can see the lies with our own eyes. We will demand truth, transparency and accountability.

He’s trying to pretend to be neutral (possibly in fear of being sued for defamation by the ICE Agent), but how can anyone call it a horror without knowing the facts? Of course, it could turn out the ICE Agent acted badly, maybe even maliciously, but in a Schrödinger’s Cat sort of way, it could just as easily turn out that the shooting was legally and morally justified. We just don’t know. But this is who is running the Democrat Party these days: Every time law enforcement acts, they leap the worst possible conclusion before they have the facts.





Meanwhile, the Mayor of Austin is behaving even worse:

With the rogue nature of ICE and the chaos we’re seeing fomented by ICE, there’s no reason to be surprised.

Austinites have a right to know what happened and they have a right to feel safe in their community.

Though APD was not involved in the shooting, I believe that there needs to be an investigation that APD assures is clear-eyed, as complete as possible, and independent. I’ve discussed this with Chief Davis. Chief Davis deployed APD’s Special Investigation Unit and the Unit has been on scene this afternoon. This is the same unit that investigates Austin’s officer involved shootings.

Chief Davis has also been in contact with the Texas Rangers and has asked the Rangers to assist in an investigation. This participation with the Texas Rangers will be important due to the access the Texas Department of Public Safety had early in the incident.

As the city continues to receive more information, we will make sure to keep the community aware.

Again, for all he knows, this was a very clean example of self-defense. We aren’t saying it is, we are only saying we don’t know one way or the other.





Next up we have this from a local reporter:

Then the officer got out and shot the driver 5 times through the windshield.

He followed it up by noting that there was a dispute in the accounts, and Austin Police Chief Lisa Davis cast doubt on the councilman’s claims, using video from a press conference. But frankly the video is better on Nick Sortor’s account:

Austin PD calls this FALSE: ‘That’s NOT what I’m hearing. This is the problem with getting in front of the camera too soon without the information. From what I’m hearing, there was a small foot pursuit.’

‘It was ONE gunshot wound.’

The man’s wife has ALREADY admitted he tried to DRIVE AWAY when being pursued by agents, even with an ICE vehicle blocking his own vehicle.

The subject is ALIVE, stable, and receiving medical care.





Meanwhile, that CBS News article above published this claim:

According to two federal law enforcement sources, ICE agents were looking to apprehend a Venezuelan man living in the U.S. illegally and with a deportation order. The sources confirmed to CBS News that the Venezuelan man is the person who was shot, but they did not disclose his identity.

But since this is based on anonymous sources, we will simply say the circumstances are disputed and we will wait for more

Don’t mess with Texas (Law Enforcement)!

Hopefully, cooler heads will prevail and people will wait for the facts before jumping to conclusions. Okay, we don’t have a lot of hope on that point, but what can you do?
